DOLE-RO I reminds employers on 13th Month Pay compliance

The Department of Labor and Employment-Regional Office I today reminded employers on their obligation to pay the 13th month pay of their workers. 

The reminder was issued at the height of the monitoring conducted by the DOLE-RO I on compliance of employers with Presidential Decree 851, or the 13th Month Pay Law. 

Regional Director Nathaniel V. Lacambra said that every covered employer shall make a report of his compliance with the law to the nearest regional or field office not later than January 15 of each year. 

Based on the law, the report shall include the following information: name of establishment; address; principal product or business; total employment; total number of workers benefited; amount granted per employee; total amount of benefits granted; and name, position and telephone number of person giving information. 

“Non-payment of the 13th Month Pay law shall be treated as money claims cases and shall be processed in accordance with the Labor Code and relevant rules,” Director Lacambra said. 

Meanwhile, the DOLE-Central Pangasinan Field Office reported that a former employee of a manpower agency in Central Pangasinan received his withheld 13th month pay amounting to P4,265 through the Single Entry Approach (SENA). Acting on his request for assistance filed on January 8, the DOLE-CPFO SENA Desk Officer was able to convince the employer to settle his money claims on the first conference on January 24.  

“Hindi po ako nagkamali na dumulog sa DOLE dahil nabigyan kaagad ng aksiyon ang aking problema.  Nagpapasalamat po ako dahil maasikaso po sila sa kliyente,” the employee, who is a person with disability, said. 

 

PD 851 provides that the 13th month pay, which is one twelfth of the basic salary earned by the employee within a calendar year, shall be given not later than December 24 of every year.  A covered employer, however, may pay one-half of the 13th month pay before the opening of the regular school year and the other half on or before the 24th day of December of every year.  END/Arly Sta.
